Welcome to SentSafe, LLC (“SentSafe,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our HIPAA-compliant software-as-a-service (SaaS) platform (the “Service”). By registering, accessing, or using our Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Service.
You may use the Service only if you are a licensed healthcare provider or a representative of a healthcare organization authorized to handle Protected Health Information (“PHI”) in accordance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and you have the authority to enter into these Terms.
SentSafe is designed to be compliant with HIPAA standards. However:
- Use of the Service requires a signed Business Associate Agreement (BAA).
- You must execute a BAA with SentSafe before storing, transmitting, or processing any PHI through the Service.
- Initially, the BAA will be manually executed. Future updates may incorporate automated execution through the platform.
You agree not to transmit any PHI through the Service unless a valid BAA is in place.
SentSafe provides tools for secure and HIPAA-compliant transmission of:
- Physical letters
- Checks
- Emails
The Service is available only via paid subscription plans.
You agree to:
- Use the Service only for lawful purposes and in compliance with all applicable laws, including HIPAA and state privacy laws.
- Ensure that your employees, contractors, and agents are trained in and comply with HIPAA obligations.
- Not use the Service to send unsolicited communications or spam.
- Maintain the confidentiality and security of your login credentials.
You are solely responsible for all activity conducted under your account.
SentSafe uses trusted third-party services to support the delivery of its platform, including but not limited to:
- hosting and infrastructure
- payment processing
- secure email delivery
- letter and check fulfillment
- file storage
SentSafe signs Business Associate Agreements (BAAs) with all providers as necessary to ensure compliance with HIPAA. By using the Service, you acknowledge and agree that certain aspects of your data, including PHI, may be processed through these third-party services.
SentSafe is not responsible for the acts or omissions of third-party service providers, except as required by applicable law or under an executed BAA.
All Services are provided on a paid-subscription basis. You authorize SentSafe or its payment processor (e.g., Stripe) to charge your designated payment method on a recurring basis. All fees are non-refundable unless otherwise stated.
These Terms remain in effect for as long as you use the Service. Either party may terminate the agreement at any time with notice.
Upon termination:
- Your access to the Service will be disabled.
- SentSafe will retain PHI for a limited period of 30 days after termination.
- You are responsible for exporting any necessary data within 30 days of termination.
To the maximum extent permitted by law, SentSafe shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including damages for lost profits, goodwill, or data.
Our total liability for any claims under these Terms shall not exceed the amount paid by you to us in the 12 months prior to the event giving rise to the claim.
You agree to indemnify and hold harmless SentSafe, its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including legal fees) arising out of:
- Your use of the Service,
- Your violation of these Terms,
- Your violation of applicable law, including HIPAA,
- Any PHI or other data you submit or transmit through the Service.
